General Terms and Conditions of Vita Drogerie AG

1. Prices

1.1 The prices are non-binding, price differences between the web shop and the shop prices are possible.
1.2 The prices are inclusive of VAT.

2. Availability

2.1 The availability of the products offered depends on the current stock levels at several locations; all products offered are also available in drugstores within a short time. Changes due to supply bottlenecks are possible. Please enquire at the shops about current availability.
2.2 We reserve the right to reduce or even cancel orders in the event of supply bottlenecks. If replacement items are available, we will offer them to you. A change to the order may also affect the shipping costs.

3. Dispatch

3.1 The shipping costs incurred are calculated by entering the recipient country and the desired delivery time. All shipments are insured differently depending on the parcel size and recipient country.
3.2 We have no influence on the customs regulations in the recipient country (outside Switzerland); this may result in additional costs which will be charged directly to the customer. The dispatch takes place with customs declaration. A deduction of Swiss VAT is not possible.
3.3 Defective or non-received orders must be reported to the nearest post office with any available tracking code. The completed report must be sent electronically to the seller by e-mail for further processing.

4. Payment methods

4.1 Payment with Mastercard, Visa or Postcard is made via Saferpay. Payment will only be processed as soon as the order is ready for dispatch.
4.2 In the case of advance payment, the order will be processed as soon as the order amount has been credited to the following account:

4.3 Purchase on account: The payment method purchase on account is not available for all offers and requires, among other things, a successful credit check by CRIF AG. When purchasing on account, the invoiced amount is due within 30 days of placing the order and must be paid to the account specified on the invoice. If the payment deadline is not met and no fixed expiry date has been agreed, the customer will be sent a reminder for late payment. In the event of late payment, the defaulting customer shall be charged default interest of 5% plus a reminder fee of CHF 10. If the claim is not settled even after a further reminder has been sent, Vita Drogeire reserves the right to assign the claim to a third party or to instruct a third party to collect the debt at the customer's expense. The amount of the prosecution/collection costs is calculated on the basis of the outstanding claim: up to CHF 150 maximum CHF 80, up to CHF 600 maximum CHF 175, up to CHF 1,000 maximum CHF 230, up to CHF 10,000 maximum CHF 860, above that maximum 9% of the outstanding claim.
4.4 PayPal: With PayPal you pay from your PayPal account or a credit card recognised in your country such as: Mastercard, Visa, Diners, American Express and Discover, further payment methods are being added to PayPal on an ongoing basis.

5. Remedies

5.1 Remedies require counselling.
5.2 They are sold exclusively through drugstores.
5.3 For risks and side effects, read the package leaflet and ask a specialist.

6. Hazardous substances

6.1 Hazardous substances are labelled with the necessary safety instructions and warnings on the packaging.
6.2 They are only sold to responsible persons with sufficient knowledge of the product.
6.3 By ordering hazardous substances, you confirm that you will comply with the safety instructions on the packaging.

7. Right of return and cancellation

7.1 Contact us before returning an item.
7.2 To make use of the right of cancellation, we need the goods unopened within 14 days of delivery.
7.3 Excluded from the right of cancellation are unsealed packaging, food, dietary supplements, hygiene articles, medicines and supplies (available from 2 days).
7.4 Returns must be sent with sufficient postage to the following address: Vita Drogerie, Retouren, Theaterplatz 1, 5400 Baden, Switzerland.
7.5 Any refund will be made to the means of payment selected when the order was placed, less shipping costs and a CHF 10 processing fee.
7.6 Orders that have already been received and have not yet been handed over to the post office will be refunded with a deduction of CHF 10 processing fee.

8. Retention of title

The goods delivered by us remain our property until all our claims have been fulfilled, regardless of the legal grounds.

9. Exclusion of liability

The entire content of the vitadrogerie.ch website is protected by copyright (all rights reserved). However, no guarantee is given for the correctness, reliability or completeness of the information contained on the website.

10. Final provisions

Should one or more provisions of these GTC be invalid, this shall not result in the invalidity of the entire contract. The invalid provision shall be replaced by the relevant statutory provision.
Swiss law shall apply exclusively.

11. Place of jurisdiction and place of fulfilment

The place of jurisdiction and place of fulfilment is 5400 Baden - Switzerland.
